1. Agreement to Terms

Welcome to Nsikacart ("Platform," "we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using the Platform.

2. Nature of Service

Nsikacart is an online marketplace designed to facilitate connections between independent sellers ("Vendors") and buyers. Nsikacart provides the digital infrastructure for product listings, wishlist engagement, and discovery.

IMPORTANT: Nsikacart is NOT a party to any transaction between users. We do not process payments, arrange deliveries, or guarantee the quality of items listed. All transactions are independent agreements between the buyer and the seller.

3. User Responsibilities & Consented Communications

• Accuracy: Users must provide true, accurate, and current information during registration and listing.
• Security: You are responsible for maintaining the confidentiality of your account credentials and session tokens.
• Consented Communications: Buyers who explicitly opt in to seller contact ("Let seller contact me") when saving items acknowledge that vendors may reach out directly via WhatsApp, phone, or email regarding those items. Vendors agree to use buyer contact leads strictly for transactional inquiries concerning the saved item and never for unsolicited marketing, spam, or harassment.
• Due Diligence: Buyers are solely responsible for verifying the legitimacy of sellers and the quality of products before making any payment.

4. Role & Liability

Nsikacart acts strictly as a directory, engagement tracker, and listing service. Under no circumstances shall Nsikacart be liable for any direct, indirect, incidental, or consequential damages resulting from:

• Disputes between buyers and sellers.
• Unsolicited communications resulting from direct user exchanges.
• Fraudulent activity by any user.
• Product defects, misrepresentations, or failed deliveries.

5. Prohibited Activities

Users may not use the Platform for any illegal purpose or abusive behavior. Prohibited activities include, but are not limited to:

• Listing prohibited or restricted items (see Marketplace Policy).
• Harvesting buyer contact details, scraping seller email queues, or abusing the wishlist notification system.
• Contacting buyers who have not granted explicit consent or who have subsequently revoked contact consent.
• Engaging in deceptive or fraudulent trade practices.
• Harassing other users or platform staff.
• Attempting to bypass platform security, rate limits, or automated scanners.

6. Termination of Access

We reserve the right to suspend or terminate any account, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise detrimental to the Platform's integrity. For example, sellers who receive 3 valid abuse reports will face automatic disabling of lead notifications and account suspension.

7. Changes to Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. Continued use of the Platform after such changes constitutes acceptance of the new Terms.
